Terms of Service

1. Acceptance of Terms
By accessing or using Fred it Right (the “Service”), operated by Fred it Right (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Fred it Right is an AI-powered waste classification platform that helps municipal residents determine how to properly dispose of items. The Service provides:
- AI-based waste classification via text input or image recognition
- Personalized pickup schedules based on your residential address
- Recycling depot locations and navigation
- A chatbot for waste-related questions using municipal data
- Multilingual support (English and French)
3. User Accounts
To access certain features, you must sign in using your Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Submit false, misleading, or inappropriate content through the classification, feedback, or contact features
- Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
- Interfere with or disrupt the integrity or performance of the Service
- Use automated systems (bots, scrapers) to access the Service without our written permission
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
5. AI-Generated Content Disclaimer
The waste classification and disposal guidance provided by the Service is generated by artificial intelligence and is intended as a helpful reference only. While we strive for accuracy using official municipal data:
- AI classifications are not guaranteed to be accurate. The AI may occasionally misidentify items or provide incorrect disposal instructions.
- Municipal rules may change. There may be a delay between official rule changes and updates to our system.
- Always defer to official municipal guidelines when in doubt. Our Service supplements, but does not replace, your municipality’s official waste management resources.
We display confidence scores with every classification. Items classified with lower confidence include clarifying questions to improve accuracy.
6. Intellectual Property
The Service, including its design, code, AI models, branding, and content, is owned by Fred it Right and protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
Municipal waste data used by the Service is sourced from publicly available government resources and remains the property of the respective municipalities.
7. User Content and Feedback
When you submit feedback (such as classification corrections or thumbs up/down responses), you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service. Feedback is stored anonymously and is not linked to your personal identity.
Images submitted for classification are processed in real time and are not retained after the classification response is returned.
8. Municipal Partnerships
For municipalities accessing the Service through a partnership agreement, additional terms may apply as specified in your separate service agreement. In the event of a conflict between these Terms and a partnership agreement, the partnership agreement shall prevail.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Fred it Right and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Damages arising from incorrect waste classification or disposal guidance
- Fines, penalties, or costs resulting from improper waste disposal
- Loss of data or unauthorized access to your account
- Any interruption or cessation of the Service
Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Indemnification
You agree to indemnify and hold harmless Fred it Right and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of New Brunswick.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
